Mickel Dolloff in fatal motorcycle crash in Gaines County, Texas.

Mickel Jay Dolloff was involved in a fatal motorcycle accident in Gaines County, Texas. According to law enforcement, the accident occurred at about 9 PM on FM 181. Dolloff was driving a Harley Davidson motorcycle south when the driver of a F-250 pick-up truck, Patrick Kennedy hit him. Kennedy was northbound and was attempting to pass another car in front of him. He went into the southbound lane and collided with the motorcycle. Though Kennedy was not injured, Dolloff died from the injuries he sustained in the accident.

Motorcycle accidents are not uncommon in Texas.

Erik Vargas also was involved in a fatal motorcycle accident, in Harlingen. The accident occurred at about 7 PM at the intersection between New Combes Highway and Loop 499. Vargas was driving a Yamaha motorcycle when he hit a GMC Jimmy SUV. The driver of the SUV was a 19-year old Harlingen resident. Though Vargas was taken to the hospital, he died later, from the injuries he sustained in the accident.

Our thoughts and hearts go out to the victims’ families. We understand that they may be deeply affected by these accidents. We also understand that they may have many questions.

In the first accident, we wonder if the case could trigger a wrongful death claim. Was this a case where the driver of the car misjudged the distance to pass the other driver? Since it was night when the accident occurred, could the driver of the car see the motorcycle? Was the pass legal at the time it was being taken?

Not much is known about the second accident, though an investigation is currently being done. Was this an issue of right-of-way? Was speed a factor in the accident? Were stop signs or lights not seen or heeded?
