On Behalf of | Jul 24, 2013 | Wrongful Death |

Do you have a wrongul death case? Let’s take a look at the story below first to see if the elements of a wrongful death case appear for comparison purposes.

A car accident in Texas led to the deaths of three people and serious injuries for two other individuals. The accident happened at approximately 2 p.m. on Interstate 20 near Odessa, Texas. A 32-year-old woman lost control of her car and crossed the center median after one of her tires blew out. Her Ford pickup then collided with an oncoming Dodge pickup truck.

The 23-year-old driver of the Dodge pickup and one of his passengers both died on Monday, July 22 following the accident. The driver of the Ford pickup died the following afternoon at Medical Center Hospital. Two other passengers in the Dodge pickup were hospitalized with injuries. One was listed in critical condition while the other had been upgraded to serious condition.

In order to answer the question, we need to examine whether the accident was the result of someone’s negligence. What do you think?

Though the Odessa accident was caused by unfortunate circumstances, fatal car accidents caused by another driver’s negligence or recklessness can often cause financial distress for the victim’s surviving family members and dependents. They may face a number of significant expenses as a result of the accident, including medical bills, final expenses, pain and suffering and financial hardship caused by the loss of the victim’s wages. Family and dependents may choose to file a wrongful death suit to recover compensation for those expenses.

An attorney with experience in handling wrongful death suits could evaluate the details of the accident and make a recommendation on how to proceed and how much in damages to pursue. If a suit is filed, the attorney could prepare and present the case, introduce supporting evidence and question witnesses. In the event of a settlement, the attorney could negotiate on behalf of the plaintiffs to obtain favorable compensation.
