Houston attorney comments on real estate disclosures

On Behalf of | Feb 22, 2016 | Real Estate |

Texans understand that they often have to hire a Houston real estate attorney since they understand the various notice provisions related to real estate law. Section 5.008(b) of the Texas Property Code contains another required notice effective January 1, 2016. The statute amends the seller’s residential disclosure form to include a statement of whether any portion of the property is in a groundwater conservation district or a subsidence district. The seller must disclose only what he or she knows. There is no duty to investigate.

This Houston law firm receives many calls related to complaints about a seller failing to provide notices and certain disclosures. Showing fraud, though, is a challenge in many situations. However, when the evidence lines up, it just may be easier than anticipated.
