Homeowners obtain judgment against Bradley W. Chance d/b/a Bradley Custom Pools

The attorneys at the Houston law firm, The Weaver Law Firm helped clients obtain a judgment against Bradley W. Chance d/b/a Bradley Custom Pools. On or about August 7, 2013, Plaintiffs contracted with Bradley W. Chance, d/b/a Bradley Custom Pools to build a custom pool and surrounding deck. Defendant’s construction work on the pool and deck project was defective and contrary to the requirements of the contract including but not limited to the following ways: (a) The heater and filtration system was installed in the incorrect location and underneath the slide which prevents maintenance on the system and exposes individuals to carbon monoxide poisoning; (b) The slide is not completed; (c) Rock used around the pool and waterfall are not secure; (d) Rock used around the pool and waterfall are not sealed; (e) The pool auto-fill function did not work; (f) The deck was improperly leveled; and more.

Plaintiffs gave Bradley W. Chance d/b/a Bradley Custom Pools notice pursuant to the Deceptive Trade Practices Act and Residential Construction Liability Act on April 24, 2014. No response was received. The Plaintiffs also alleged causes of action that include: Breach of Contract, Breach of Warranty, Breach of Fiduciary Duty, and Fraud.
