Jose Damian died after accident with drunk driver in Humble

On Behalf of | Nov 9, 2015 | Wrongful Death |

Jose Damian died after being hit in an accident with a drunk driver in Humble, Texas. This fatal incident occurred on November 8, 2015. We would anticipate that this case may result in a wrongful death lawsuit, especially since evidence proves the driver, Charles Baxter, was intoxicated.

Damian and his family members stopped on the the side of the Eastex Freeway after realizing their tire had lost significant tire pressure. After the tire was repaired, Damian went under the vehicle to remove the jack. Suddenly, Baxter’s vehicle crashed into the car that Damian was under. Damian died as a result of the critical injuries he suffered. Our hearts and prayers go out to his family and friends.

Damian had just recently turned 17 years old and was in his second year in high school. It is truly sad that he was the result of someone’s selfish actions. Driving under the influence is highly selfish, because Baxter clearly did not take in consideration the other lives that were on the roads.

There is simply no excuse for operating a vehicle while under the influence. Every time someone turns the key to start the engine it is their responsibility to ensure that they are not impaired in any way.

Baxter was arrested after he was released from the hospital. He has been charged with intoxicated manslaughter and possession of a controlled substance.

There are some questions that may still need answers and some actions that may need explanations. Personal injury lawyers do not always rely on the police reports. They often hire private investigators to find the answers to additional questions. Investigators often obtain helpful information that is not included in the police report, information that family members sometimes want to know.

The facts of this case may support a wrongful death lawsuit. The Weaver Law Firm understands that family and friends may have plenty of questions regarding wrongful deaths and accidents caused by drunk drivers.
