Motorcycle accident near Dayton may result in wrongful death case

A motorcycle accident near Dayton, Texas may result in a wrongful death case.There have been more recent motorcycle accidents in Texas. However, the location of this particular accident was on Hwy. 1960 at CR 611 near the West Liberty County line, close to the City of Dayton City Limits. The accident involved a motorcycle rider and a tractor-trailer.

A San Antonio man died in a motorcycle accident on FM 1960 at CR 611, three miles west of Dayton. The accident was on Monday, Jan. 27, 2014. A report indicates that the man was identified as Sean Anthony Hanner. He was 21 years old.  The motorcycle driver crashed into an 18-wheeler truck driven by Brian Everett Herald, 45, of San Antonio.

According to a DPS fatality report, early morning fog may have contributed to the accident. The truck driver may be negligent in this particular case for failing to yield to the right of way. The DPS report also states that “due to the dense fog, [the truck] may have failed to yield right-of-way.” The motorcycle driver died at the scene. At this point, the victim’s family may have questions on whether this accident results in a wrongful death case. 

Police officials stated: “The preliminary indications are that the tractor-trailer was heading south off CR 611 and turning east off CR 611 onto Hwy. 1960 while the motorcycle rider was headed west on Hwy. 1960. It appears the motorcycle struck the middle of the trailer”
