Crewmember Latest Wrongful Death Victim Aboard Carnival Cruise

Could a wrongful death lawsuits be in store for Carnival Cruise Lines? Carnival Cruise Lines has garnered more than its fair share of bad press in the last year. Everything from food poisoning to power outages to steering mechanism failure, Carnival has been at the epicenter of bad news.

Just last week a 6-year-old Florida passenger drowned in a pool aboard the Carnival Victory. This accident occurred while the ship was out at sea. Although it is though that this was an accidental drowning, who was supervising this child? Could Carnival be held liable for this wrongful death?

A forlorn streak seems to plague Carnival as another fatality ensues. Yesterday morning, a Carnival employee was killed while performing maintenance on the Carnival Conquest. The accident occurred while the Carnival Conquest was docked at the port in New Orleans. The unidentified man was performing maintenance work on the exterior of the ship using a device known as a man lift or cherry picker. The worker became wedged between the man lift and a platform and was crushed to death. Perhaps the man lift was defective, or perhaps Carnival did not provide this man sufficient training to operate this machinery.

The Jones Act, which is a federal law that protects injured seamen, also applies to cruise ship workers. A thorough investigation should be conducted to determine who the responsible parties are and justice be served.

We can only imagine the heartache that these individuals’ families have and will continue to endure following these tragic losses. Though words seem insufficient to express our sorrow, our hearts go out to their loved ones.
