32-year-old Danny York of Early, Texas died on Saturday from injuries suffered in an ATV rollover accident. The Suzuki 700cc rolled several times causing York to strike the pavement. He was unfortunately not wearing a helmet. York was transported to the Brownwood Regional Medical Center where he succumbed to his injuries becoming another potential wrongful death victim.
Leading up to the accident, York had driven the 4-wheeler down the street and was heading back when the ATV rolled. At the time of the accident, York was traveling about 50 miles per hour. Regardless of the facts of the accident a family is grieving the loss of a loved one. We send them our most sincere condolences.
With many open and beautiful space in Texas, it is difficult not to want to enjoy the outdoors. However, it is important to remember that ATVs just like motorcycles offer no protection to the riders. A leisure ATV ride can become extremely dangerous and even end in wrongful death in a matter of seconds. Many of the injuries from 4-wheelers also known as “quads” can result from manufacturer errors and flawed design. Injuries often include broken limbs, but can be severe enough to be fatal.
A well-known ATV model, the Yamaha Rhino model is notorious for roll overs due to its tapered wheel and top-heavy disproportionate design. This model could roll over even when driven carefully on flat terrain. The thrill of riding an ATV is not worth the possibility of a wrongful death.
According to the Consumer Product Safety Commission Texas is one of the leaders in ATV-related death, with 612 fatalities reported between 1982 and 2011. Families of those injured or killed in 4-wheeler accidents should speak to a personal injury lawyer about their legal rights.
