A horrible car accident that occurred near Freer on U.S Highway 59 left two dead and about four critically injured. Texas has lost dear six-year-old John Daniel Martinez and 15-year-old Daniel Perez Cervantes in this fatal car accident. These children were pronounced dead at the scene. Nine other individuals were taken to different area hospitals. Maura Flor Acosta was taken to Memorial Hospital in Corpus Christi. Brandon Acosta was taken to Driscoll Children’s Hospital. Eva Vargas and Erasmo Vargas Moreno were taken to the University Hospital in San Antonio. Jose Antonio Rosales Jr., the driver of the freight liner, was not injured in the accident. Miguel Angel Acosta and Mario Mesa were treated and released from the hospital. Herberto Acosta Bernudez and Carlos Ignacio Perez Cervantes were also treated and released.

The accident occurred this past Thursday morning at 3:56 a.m. It involved a 1997 Chevy Van towing a utility trailer and a 2010 freight liner truck. According to reports coming out of Texas, both vehicles were traveling northbound when the trailer became disabled from the van in the middle of the traffic lane. A Texas state trooper for the Department of Public Safety trooper said the freightliner struck the van on the left side and the utility trailer struck the van on the right side causing multiple people to be ejected from the van.

We understand that the family of the children that died in this horrible accident has a lot of questions. Who was at fault? How could this accident have been prevented? While police authorities conduct their own investigation, attorneys can conduct their own private investigation in order to determine who was at fault. The family may want to know if they have a wrongful death claim against a negligent driver.
