In Lindale, Texas, the Lindale police have reported that the death of a pedestrian that occurred on November 7, 2013 an accident. But is this a wrongful death case?

The pedestrian accident happened around 7:45 p.m., Thursday evening. Police officials report that the male individual was walking across the street at the 3400 block of Highway 69. It was when the pedestrian was walking across the street that he was hit by an SUV that was on its way toward Lindale. The man was killed after being struck by the vehicle. He died at the scene. Police have not release the man’s name.

KLTV news reported and obtained the following quote: “They hit in front of The Hampton Inn and Best Western Inn and he was laying right in front of the Taco Bell. His stuff is in a trail. He was literally knocked out of his shoes.” says Felicia Sutton, a woman who witnessed the incident.

KLTV news also reported and obtained the following quote: “It’s hard to get back to work. This is all I can think about,” says Kaila Chapman, another witness at the scene.

We suspect that the driver of the car that hit the man walking across the street is cooperating with law enforcement officials, but what are the full details of the accident? Was the driver talking on a cell phone? Was the driver speeding? Was the driver keeping a proper lookout? Could the driver have avoided the accident?
