How can a TX real estate contract protect me from injury claims?

How can a Texas real estate contract protect you from personal injury claims or wrongful death claims? Well, first remember that injuries often occur on real property, especially investment property and place of employment.

Work-related Texas wrongful death accidents happened often in cities like Houston and San Antonio.

It is a company's responsibility to provide employees and workers a safe place of work. Workers and employees need to be able to work in a safe environment. These are some of the first steps that an employer needs to protect herself, the business and employees. Texas real estate contracts also come into the process.

If the property owner leases real estate to a business owner, the property owner should include protective clauses in the contact. For example, the property owner should have the tenant or business owner agree to be in compliance with all Texas laws and governmental laws.

It should be the tenant or business owner's sole cost, expense and liability and responsibility to comply with all present and future laws, ordinances, orders, rules, regulations and requirements of all federal, state municipal and local governmental bodies that relate to the real estate property.

The real estate owner should also make sure that the business owner is observing these other areas if wrongful death or injury claims is a concern. The business owner should further observe and comply with the requirements of all policies of public liability, fire and all other policies of insurance at any time in force with respect to the real estate property or leased premises. The real estate owner should have the tenant or business owner take and accept the premises subject to all applicable zoning, municipal, county, and Texas state laws. The real property should require the business owner to indemnify and hold the property owner harmless against any claims which may arise out of the tenant's failure to comply with the laws. Such indemnification should also include, but not necessarily be limited to reasonable attorney fees, court costs, and claims.

If you have questions about how real estate contract relate to personal injury or work related injury claims, feel free to call a Texas personal injury lawyer that also practices real estate law. You can reach a Houston lawyer at 713-454-7875.
