Wrongful Death Wheelchair Accident on Fredericksburg Rd, San Antonio?

On Behalf of | Sep 28, 2013 | Wrongful Death |

Yesterday, on Fredericksburg Road in San Antonio, Texas, a man in a wheelchair was killed when he was hit by an SUV. The San Antonio Police Department investigated the scene of the pedestrian accident. Is this a wrongful death case?

The scene of the pedestrian fatality happened at Fredericksburg Rd. between Gardina and Vance Jackson. The car accident happened around 7:50 a.m.

People believe that the man in the wheelchair was trying to cross Fredericksburg Road in San Antonio, Texas. That was when he was hit by a SUV. The driver of the SUV is 56-year old Rita Mendiola. She stopped at the scene and waited for the police. The driver said that she did not see the pedestrian.

The pedestrian is a 79-year old male in a motorized wheelchair. The accident occurred on the Northwest side of San Antonio. Some questions that an attorney will ask is if the driver failed to keep a proper lookout for the pedestrian as a person should do with ordinary prudence under the same or similar circumstances. An attorney should also ask whether the SUV driver failed to operate the SUV at a rate of speed that is reasonable and prudent to avoid colliding with any person or motorized wheelchair.

Our hearts and prayers go out to the man that died in this horrible accident.
