Richard Weaver of The Weaver Law Firm successfully defended a commercial transportation company in a wrongful death lawsuit. The case was called to trial and judgment was found in favor of the defendant, Weaver’s client. The Weaver Law Firm is pleased as well as its client.

In the most recent suit, Weaver defended against the plaintiffs’ claims after the decedent was struck by a 2005 Freightliner and flat bed trailer operated by another driver. The decedent died as a result of the 18-wheeler accident.
It was the defendant’s position that the decedent made an improper left turn by entering the roadway from the right shoulder in an attempt to cross both lanes of traffic, failing to yield to the right of way to the freightliner that crashed into him. The law firm also relied on a witness that stated that the decedent was using his cell phone at the time of the accident in order for the firm to conclude that its client was not negligent.
